American policy makers /agencies/ Pharma companies have consistently bullied Indian Pharma sector, Medical tourism companies, Surrogacy clinics etc by using strong arm tactics and using paid and sponsored media to present a distorted picture and now have done the same for Surrogacy in Thailand.
Recently a majority of members of the LGBT community who could not continue to have babies in India through surrogacy turned to Thailand and the issue of Israeli babies born to Thai surrogates made the news as various parents are fighting for permission to come home with their newborns. consistent with the days of Israel, surrogacy in Thailand is now complicated thanks to a brand new law under that babies born to Thai ladies are mechanically given citizenship. Further, Thai law states that ladies (including surrogates) who offer birth to a child have full parental rights to those babies, as well as the right to custody.
But what if intended parents cover all their bases and file all required legal paperwork? unfortunately, doing so doesn’t solve the matter. even if supposed parents apply for and receive an Israeli passport for the baby, they still may not be permitted to depart Thailand with their baby in tow. consistent with Thai authorities, baby’s passport is not seen as proof that the birth mother (surrogate) signed documentation that surrenders her custody of the child. And a minimum of one surrogate who visited the Israeli consulate face to face to produce these needed signatures was reportedly turned away.
In an effort to deal with the case, Israeli administration offered an announcement that instructed Israeli gay couples to avoid surrogacy procedures in Thailand. The Foreign Ministry statement declared, “The State of Israel will not be able to continue to assist parents to children born in Thailand through surrogacy starting on November thirty, 2014, and reiterates its warning to Israelis not to get surrogacy services in Thailand thanks to authorities’ stance in this country.” The Foreign Ministry also issued a warning to Israelis to not look for surrogacy service in Thailand. “The truth is, under Thai law, these babies citizens Thai because of in every sense,” the ministry aforementioned in a statement.
