The Altruistic Surrogacy (Regulation) Act, 2021
This law permits altruistic surrogacy only. The surrogate mother is a compassionate volunteer who carries a pregnancy for intended parents without commercial payment, except for medical and insurance coverage. To understand the guidelines and eligibility in detail, learn more here
Who Can Apply?
- Legally married Indian man and woman above 21 and 18 years old, including Non-Resident Indians (NRIs) and Overseas Citizens of India (OCIs)
- Must have a medical necessity for gestational surrogacy.
- The child must be genetically related to the couple. If a donor egg or sperm is needed, at least one gamete must come from the intending couple.
- Indian widows or divorcees between 35–45 years old.
- The child must be conceived using the woman’s own eggs and donor sperm.
- A willing, ever-married woman.
- Between 25 to 35 years old.
- A mother with at least one child of her own.
