Understanding Surrogacy in India
A Clear and Simple Guide to The Surrogacy (Regulation) Act, 2021

THE ALTRUISTIC SURROGACY (REGULATION) ACT, 2021 was passed by Indian Parliament in December 2021 – IVF Clinic Hyderabad | IVF Treatment in Hyderabad

The law permits altruistic surrogacy only. This means the surrogate mother is a compassionate volunteer who agrees to carry a pregnancy for intended parents without any commercial payment, other than medical and insurance coverage .

Eligible Intending Couples Must Be:

  • legally married Indian man and woman above the age of 21 years and 18 years respectively, including Non-Resident Indians (NRIs) and Overseas Citizens of India (OCIs) .
  • The couple must have a medical necessity requiring gestational surrogacy.
  • The child must be genetically related to the couple. In specific medical cases where a donor egg or sperm is necessary, the child must still have at least one gamete (egg or sperm) from the intending couple .

Eligible Intending Women:

  • An Indian widow or divorcee between the age of 35 and 45 years can avail surrogacy.
  • In this case, the child must be conceived using the intending woman’s own eggs and donor sperm.

The Altruistic Surrogate Mother:

To protect surrogate mothers, the law sets clear criteria. She must be:

  • willing, ever-married woman.
  • Between 25 to 35 years of age.
  • A mother who has at least one child of her own.
